Virginia driver charged in fatal crash he caused, police say

On Wednesday, Banya was charged with Failure to Maintain Proper Control. He was served a summons and then released.

FAIRFAX COUNTY, Va. — Fairfax County detectives from the Crash Reconstruction Unit have charged the driver who lost control of his car in a fatal July 13 car crash

Officials say Mukeh Banya, 21, was driving a 2003 Honda Accord along Old Yates Ford Road when he lost control of his car and crossed over the double yellow line. Banya's car began to spin out before being hit by an oncoming car on the passenger side of the vehicle. 

Banya was travelling with a passenger, Jack Gumm, who took the brunt of the impact and sustained very serious injuries. Gumm was taken to a local hospital where he succumbed to his injuries and passed away two days later. The driver of the other car was uninjured. Police say alcohol did not appear to be a factor in the crash, but speed is being investigated.
