LOUISVILLE, Ky. (WHAS11) -- The Glenmary man sentenced to 10 years in prison for shooting a 12-year-old boy who was playing "ding, dong, ditch" will be released from prison early.
The family of Jacob Eberle got a when they found out the man responsible for shooting Jacob will be released from prison Monday on shock probation.
"I just kept thinking, 'How could this man have done this to my son? How could you aim and shoot at a small boy who stepped on your lawn and never even rang your doorbell?" Jennifer Eberle read in front of a Jefferson County Circuit courtroom.
Eberle never thought the man responsible for shooting her son in the back with a 12-gauge shotgun would be free after spending 100 days in prison.
Michael Bishop was granted shock probation Monday after he was found guilty in 2012 for shooting 12-year-old Jacob Eberle in their Glenmary neighborhood. Bishop accused the boy of playing 'ding dong ditch' and reacted by shooting his shotgun, which hit Jacob.
Monday, a judge granted Bishop shock probation if he accepted a sentence of 15 years rather than the original 10-year sentence. Bishop accepted the increased sentence.
"What we know happened was this was an accident," said Brian Butler, who is Bishop's attorney. "As I've said, accidents have consequences and Mike [Bishop] had consequences in this case. And as Judge [A.C. McKay] Chauvin said, 'If he [Bishop] could do it again, he would not bring a gun into his yard."
Jacob Eberle sustained serious injuries and still has scars from the pellets. His parents say he has had panic attacks in school and has been taking anti-depressants since the shooting.
Jacob's father shared his frustration about the ruling outside the courtroom.
"I'm totally disappointed," said John Eberle, Jacob's father. "To me, it's the precedent that you can come outside your house, shoot anyone you want and get 100 days in jail. If I go out today and shoot Mr. Bishop, will I get 100 days in jail?"
The Eberle's have moved out of the Glenmary neighborhood since the shooting.
Bishop will be released from custody later Monday afternoon.
