Arrest made in 31-year-old Maryland rape case, police say

Xavier Battice is being charged in connection to a 1992 rape in Chevy Chase, Maryland.

CHEVY CHASE, Md. — Police in Montgomery County have made an arrest in a rape case that stretches back more than three decades. Now, investigators are encouraging any additional victims to come forward

The Montgomery County Police Department's Major Crime Cold Case Unit announced the arrest of 62-year-old Xavier Battice on Tuesday in connection to a rape he allegedly committed on Sept. 24, 1992. 

On that day, police say a woman got off a bus in the 5400 block of Wisconsin Avenue in Chevy Chase when a man, later identified as Battice, followed her. Investigators say Battice took her to a nearby park, raped her and left. 

Cold case detectives submitted evidence from the crime scene to the crime laboratory, and a DNA profile was extracted from the evidence. The DNA was submitted into the Combined DNA Index System (CODIS) and matched to Battice.

Detectives obtained an arrest warrant for Battice, charging him with two counts of second-degree rape and one count of second degree sex assault. 

Battice, now living in Morgan Hill, California, was arrested by authorities there once they were made aware of the Montgomery County investigation. He was held in a detention center there until he was extradited to Maryland.

On Dec. 15, Battice was transported to Montgomery County Central Processing, where he is being held without bond, police said.

Detectives are concerned there may be additional victims of sexual assault by Battice that have not contacted police. Anyone with more information, or who may have been a victim of Battice, is asked to contact police at 1-866-411-8477.
