SUITLAND, Md. — The video attached is a previously released body-worn camera video from the shooting.
A Prince George's County police officer will not face charges for shooting and killing a man inside his home.
On Tuesday, Attorney General Anthony G. Brown announced he will not seek charges in the Feb. 1 fatal shooting that resulted in the death of Melvin Jay.
Officers were called to the 5100 block of Suitland Road just before 5:30 p.m. on Feb. 1 for reports of a break-in.
The 911 caller reported that someone broke into his apartment and was burglarizing his home. Dispatchers told officers that the caller was not home and didn't give a suspect description.
When the officer arrived at the apartment he noticed the door was open. When he went inside, the officer encountered Jay. The officer told Jay to come toward him and show his hands.
Instead, Jay went into the kitchen. The officer told investigators with the A.G.'s office that he heard a "dig" which sounded like "metal on metal". Jay reached into the kitchen sink and started turning towards the officer.
The officer fired one deadly round, hitting Jay and killing him on the scene. Backup officers arrived and called for first responders.
During the investigation, a gun was recovered in the kitchen sink and another was found in Jay's coat pocket. It was also discovered that Jay did not make the 911 call, but did live in the apartment.
On Oct. 10 after the investigation concluded, A.G. Brown determined that the officer involved did not commit a crime under Maryland law.
