SILVER SPRING, Md. (WUSA) -- A family is suing Montgomery County Police for $10 million. The family filed a wrongful death lawsuit in the shooting of 26-year-old Emmanuel Okutuga.

A county police officer opened fire on Okutuga last month during an incident outside City Place Mall in downtown Silver Spring.

Okutuga's family says the officer had no justification for pulling the trigger - not once, but twice.

Investigators have said Okutuga got into a dispute with a mall security guard. Officer Christopher Jordan responded. Investigators have said Okutuga was holding an ice pick and he refused the officer's order to drop it. Jordan fired two shots, killing the young man.
